Aarya Chat Pro Terms of Service

1. Formation and Scope of the Contract

Welcome to Aarya Chat Pro. By accessing, downloading, or utilizing our application, you officially enter into a binding agreement with us. This document serves as the comprehensive and exclusive understanding between you and Aarya Chat Pro, superseding any prior communications. To use our services, you must be at least eighteen (18) years of age. If you do not meet this age requirement or do not agree to these terms, you are strictly prohibited from using this platform.

2. Account Registration and Credential Security

To access certain features, you must create an account using accurate and current information. You bear full responsibility for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Should you suspect any unauthorized access or security breach, you must notify us immediately. We reserve the right to suspend or permanently terminate any account that exhibits suspicious activity or violates our policies.

3. Account Deletion and Data Retention

You have the right to delete your account and associated personal data at any time directly through the in-app settings (Settings > Account > Delete Account) or by contacting support. Once requested, your account and identifiable data will be permanently deleted or anonymized in accordance with our Privacy Policy and Google Play requirements.

4. Acceptable Use and Prohibited Conduct

Your use of Aarya Chat Pro must comply with all applicable local and international laws. In accordance with applicable regulations (including the Information Technology Rules of India), we maintain a strict zero-tolerance policy against prohibited behaviors, including but not limited to:

• Any form of Child Sexual Abuse Material (CSAM), child exploitation, or endangerment (violations will be reported immediately to law enforcement and relevant authorities such as NCMEC);
• Uploading, transmitting, or displaying non-consensual sexual content, obscenity, nudity, or graphic violence;
• Harassment, cyberbullying, stalking, threats, hate speech, or defamatory statements;
• Impersonation, fraud, deceptive practices, or promoting illegal gambling/substances;
• Content that threatens the unity, integrity, defense, security, or sovereignty of India or public order.

We actively monitor, moderate, and deploy automated/manual systems to detect violations. We reserve the right to remove non-compliant content immediately and permanently ban violating accounts without prior notice.

5. In-App Purchases and Virtual Assets

Aarya Chat Pro may offer premium features or virtual items for purchase. All transactions are final, and virtual goods hold no real-world monetary value; they cannot be exchanged for cash or transferred outside the platform. Refunds are solely governed by the policies of your respective app store provider (e.g., Apple App Store or Google Play). We reserve the right to modify pricing and availability of virtual assets at our discretion.

6. User-Generated Content and Safety Controls

You retain ownership of content you post, granting us a worldwide license to host and transmit it.

Reporting and Moderation: Aarya Chat Pro provides in-app tools allowing users to report objectionable content or abusive behavior and to block any user instantly. We commit to acting on valid reports promptly (within 24 hours for severe violations) by reviewing and removing infringing content or terminating access.

7. Intellectual Property Rights

All underlying code, algorithms, designs, trademarks, and logos associated with Aarya Chat Pro are the exclusive property of our company. Nothing in this agreement grants you any right to use our intellectual property without prior written consent.

8. Data Protection and Privacy Commitments

Your privacy is paramount. Our collection, processing, and storage of personal data are strictly governed by our separate Privacy Policy. By using Aarya Chat Pro, you consent to our data practices as outlined in that document.

9. Service Availability and Disclaimer of Warranties

Aarya Chat Pro is provided strictly on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding uninterrupted service, error-free operation, or specific outcomes. To the maximum extent permitted by law, our total aggregate liability for any claims arising from your use of the app shall not exceed one hundred US dollars ($100.00) or the total amount you paid us in the six (6) months preceding the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless Aarya Chat Pro, its affiliates, officers, and employees from any claims, damages, or expenses (including legal fees) arising from your breach of this agreement, your violation of any law, or your infringement of third-party rights.

11. Termination of Agreement

We reserve the right to terminate or suspend your access to Aarya Chat Pro at any time, without prior notice, for conduct we deem harmful to our platform or other users. Upon termination, your right to use the service ceases immediately, and you must destroy all downloaded materials. Sections regarding indemnification, liability limits, and dispute resolution shall survive termination.

12. Governing Law and Dispute Resolution

This agreement is governed exclusively by the laws of the Republic of Singapore. Any disputes arising from this agreement shall be resolved through binding arbitration administered by the Singapore International Arbitration Centre (SIAC), rather than in court. You explicitly waive any right to participate in class-action lawsuits. You also retain the right to opt out of this arbitration clause by notifying us in writing within thirty (30) days of accepting this agreement.

13. General Provisions

If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full effect. Our failure to enforce a specific rule does not constitute a waiver of that rule. You may not assign or transfer your rights under this agreement without our prior written approval. We may update these terms periodically, and continued use of the app constitutes acceptance of the revised terms.
